Acceptance of Terms
By accessing and using the MarketHD website and services, you acknowledge and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms govern your access to and use of MarketHD's financial research tools, including the Super Screener, Financial Charts, and Company Profiles ("Services").
Subscription Terms
Subscription: Access to certain Services requires a paid subscription. Subscription terms, including fees and duration, are specified at the time of subscription. MarketHD reserves the right to modify subscription plans and pricing with prior notice.
Renewal and Cancellation: Subscriptions automatically renew at the end of each billing cycle. You may cancel your subscription at any time through your account settings, but no refunds will be provided for any unused portion of the term.
Payment Terms
Payment Processing: Payments are processed through a third-party payment processor. MarketHD does not store your payment card details on its servers.
Late Payments: Failure to pay the subscription fees may result in the suspension or termination of your access to the Services.
User Responsibilities
Account Security: You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.
Acceptable Use: You agree not to use the Services for any illegal or unauthorized purpose. You must not, in the use of the Services, violate any laws in your jurisdiction.
Termination
MarketHD may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement or your MarketHD account, you may simply discontinue using the Services.
Changes to Terms
MarketHD reserves the right, at its sole discretion, to modify or replace any part of these Terms. It is your responsibility to check these Terms periodically for changes. Your continued use of or access to the Services following the posting of any changes to these Terms constitutes acceptance of those changes.
Disclaimer of Warranties
The Services are provided "as is." MarketHD and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
In no event will MarketHD, or its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.
Governing Law
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
